The present appeal has been filed against the impugned judgment of conviction and order of sentence dated 28.05.2025 passed in 2 Special Criminal Case No. 5/2024 by Special Judge (POCSO Act) Chirmiri, District- Koriya C.G. whereby the appellant has been convicted under Sections 363, 366 of IPC and Section 4(1) of POCSO Act, 2012 by the trial court and it has been brought to the notice that the appellant has already filed an appeal bearing CRA No. 1453 of 2025 which is pending before this Court. 2. Learned counsel for the appellant would submit that the present appeal is filed through the legal aid and since the appellant has already preferred appeal bearing CRA No. 1453 of 2025 which has been filed prior to the present appeal, therefore he may be permitted to withdraw the present appeal. 3. In view of the above submission, the present appeal, which is second in nature, is not maintainable. However, appellant is to pursue the appeal filed as CRA No. 1453 of 2025. 4.
