JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioners are before this Court calling in question a particular endorsement dated 25.07.2022, issued by respondent No.1 - National Highway Authority of India (for short ‘the NHAI’) through its Land Acquisition Officer, declining to accept the plea of the petitioners for grant of compensation, for the land that is allegedly utilized by the NHAI. Therefore, a mandamus also springs directing payment of compensation for the land of the petitioners that is utilized by the NHAI. 2. Heard Sri Sachin B.S., learned counsel for petitioners, Sri M. Rajakumar, learned Additional Government Advocate for respondent No.1, Smt. Shilpa Shah, learned counsel for respondent No.2 and Sri B.M.Kushalappa, learned counsel for respondent No.3. 3. Facts in brief, germane, are as follows: The petitioners are the owner of a property in Survey No.74/27A1 measuring 0.09 cents, situated at Bada Village, Kapu Taluk, Udupi District and co-owners of the said land. - 4 - HC-KAR NC: 2025:KHC:36887 WP No. 14786 of 2025 Respondent No.1 – NHAI initiates acquisition proceedings on 13.10.2014 by issuing a preliminary notification seeking to acquire land of the petitioner to the extent of ₹ 0.01.61 cents, of the total extent of 9 cents in Survey No.74/27A1, for the purpose of formation of a national highway. Pursuant to the said acquisition proceedings, the award of compensation is also determined insofar as it concerns 0.01.61 cents in the aforesaid survey number. The issue is not with regard to the compensation that was determined for acquisition of 0.01.61 cents, but the NHAI is said to have utilized excess extent of land of the petitioner i.e., upto 0.07.39 cents in Survey No.74/27A1, without paying compensation and without acquisition proceedings. Therefore, there are plethora of communications and representations between the petitioners and the respondents, seeking compensation for the alleged illegal utilization of the land and the responses thereon. The compensation, however, is not determined, but an endorsement is issued on 08.11.2022, indicating that the excess land belonging to the petitioner to an extent of 0.07.394 is utilised and observed that the land can be purchased from the landowners – the petitioners, herein. Owing to several - 5 - HC-KAR NC: 2025:KHC:36887 WP No. 14786 of 2025 representations and communications between the parties, yielding no result, has driven the petitioners to this Court in the subject petition seeking the aforesaid prayer. 4. Sri B.S.Sachin, learned counsel appearing for the petitioners submits that on the strength of certain sketch that is produced by the petitioners as well as the respondents – NHAI, would demonstrate that the land of the petitioners to the tune of 0.07.394 cents is utilized without acquisition proceedings. While certain extent of the property was acquired and utilized by payment of compensation, while some extent of land has been acquired and compensation is paid. The bone of contention now is with regard to 0.07.394 cents. The learned counsel would take this Court through the documents appended to the petition to demonstrate that it is the case of the respondents themselves that the land has been utilized without acquisition proceedings and therefore, the respondents are insisting upon compulsory purchase of the said land. He would seek that the prayer be allowed by directing the respondents - 6 - HC-KAR NC: 2025:KHC:36887 WP No. 14786 of 2025 that the compensation be paid to the petitioners in accordance with law. 5. Per contra, Smt. Shilpa Shah, learned counsel representing respondent No.2 – NHAI would refute the submissions by taking this Court through the documents appended to the statement of objections seeking to demonstrate that the land of the petitioners is not utilised as on today, but in future it may be required to an extent of 30 meters on each side for the purpose of formation of national highway road and the policy of the NHAI is to acquire certain lands adjacent to the road and the proceedings would be taken up in accordance with law, if it is necessary. Learned counsel would seek to place reliance upon certain communications between the petitioners and the authorities, to buttress her submission of non-utilization of the land of the petitioners. 6. Learned counsel for the petitioners would join issue as a rejoinder to contend that the communication from the Land Acquisition Officer to the Project Director indicating that the land of the petitioners has been utilized and compulsory - 7 - HC-KAR NC: 2025:KHC:36887 WP No. 14786 of 2025 purchase must be initiated. He would contend that all the lands surrounding the land in subject are all acquired and the petitioners land has been utilized without acquisition, therefore the petitioners seek quashment of the impugned endorsement dated 25.07.2022, and a consequential mandamus. 7. I have given my anxious consideration to the submissions made by the learned counsel for the respective parties and have perused the material on record. 8. The aforesaid facts are all a matter of record. The acquisition is initiated by respondent No.1. The petitioners are the owner of certain property in two survey numbers, one being the absolute owners and the other, as co-owners. In the acquisition proceedings, the property of the petitioners, insofar as the absolute ownership is concerned, has been acquired and compensation is paid to the petitioners. Insofar as Survey No.74/27A1, which is the bone of contention in the case at hand, the chart indicating the extent of land utilised by the respondents, is as follows: - 8 - HC-KAR NC: 2025:KHC:36887 WP No. 14786 of 2025 Respondent No.1 acquires 0.09 cents and compensation is paid. Again acquires 0.01.61 cents and compensation is paid. These two are the subject matter of acquisition and compensation. The chart would indicate that the petitioners are the owners of the land in survey No.74/27A1, totally measuring 0.09 cents. Out of these 0.09 cents, acquisition happens for 0.01.61 cents, to which the petitioners get compensation. The question of alleged utilisation comes about to the remaining land, which is 0.07.39 cents, which would approximately be 299 square meters. The contention is, that the land is utilized without acquisition. 9. Heera J. Shetty, No.1120/18th cross, HST 7th Sector, Bangalore – 560 102 Sub: Providing information / details for road widening construction in Sy.no.74/27A1 of Bada village, Yermal, Kaup taluk - reg. Ref: 1) Your application dated 10.10.2023 2) Your application dated 05.03.2024 3) CALA Kundapur letter no.N.H.LA.Q.S.R.27 /2023-24 Dt.09.05.2024 Sir, - 14 - HC-KAR NC: 2025:KHC:36887 WP No. 14786 of 2025 1. This has reference to your application 1 & 2 cited above, wherein it is intimated that, the Authority has utilized the part of Sy.no.74/27A1 for construction of Highway for which no compensation was paid to you. 2. In this regard, this office obtained report from the CALA Kundapur and they are informed that, the total 299sqm comes within the NH ROW out of which 65sqm already acquired and balance 234sqm missed out in the earlier notification as per NH ROW. Accordingly, CALA Kundapur prepared the fixation of compensation considering the latest guidance value and last 3 year sales transaction (whichever is highest). Accordingly, the compensation arrived for your missed out land is Rs.2904.21 per sqm i.e. Rs.117325 per cents. 4. Therefore, it is requested to submit your consent for Rs.2904.21 per sqm (per cents 117525) so that, this office taking further action in order to obtain approval from the Competent Authority of NHAI to disburse the same to your account after executing the sale deed in the name of NHAI. This is for your information. Thanking you,” (Emphasis added) The petitioners again submit a representation seeking compensation for utilizing the land without acquisition proceedings. It reads as follows: “From, Heera J Shetty #1120, 18th Cross HSR 7th Sector HSR Layout - 15 - HC-KAR NC: 2025:KHC:36887 WP No. 14786 of 2025 Bangalore-560102 To, The Project Director National Highways Authority of India, Door No. 3-29, Bethel Tharethota, Near Pumpwell (NH66) Mangalore-575002 Sub: S. No:-74/27A1; Dispute on 7.39 Cents; Sital Value Dear Sir, In 2022 during our survey, we found that our land on S. No. 74/27 A1 measuring 9 cents out of which 1.606 cents was acquired. We have received compensation for the same. We have received compensation for the same. The remaining 7.39 Cents is in our name, but has been used illegally by your department without acquiring. We made a representation to you and Kundapura Revenue Office in 20.08.2022 and got a positive reply on 28.11.2022 stating that our land was being used for road construction and without acquiring, the same may be purchased. Since then we have been made to run from pillar to post and delay is enormous for that reason. We then received a letter from you saying that only 5.77 Cents land has been used up and that the SITAL VALUE will not be considered. Since we are confident about our view & we approached you for a certified copy, which was not delivered to us. We applied officially for the same and got it after a delay of 2 months, in which it states clearly that RTC 7.39 Cents is in our name and only 1.61 cents is available for National high ways. Further, also we got officially measured through Govt. Surveyor and got plotting done which officially says that we own the 7.39 Cents which is in line with our demand (delay of 3 years). All documents such as RTC, plotting sketch are enclosed. - 16 - HC-KAR NC: 2025:KHC:36887 WP No. 14786 of 2025 Hence, we would like to inform you that your note saying 5.77 Cents available is wrong and request to pay the compensation for 7.39 Cents. Next important aspect of dispute is that as per registration and registrar office guidelines, less than 12 Cents should be considered as sital value, and the compensation chart for this has been given to you. We hope & pray that you will consider our request favourably and resolve this matter without further delay. Thanking You,” (Emphasis added) In reply, respondent No.1 – NHAI communicates as follows: “No.11039/2/2025/PIU (Mnglr)/474 26th July 2025 To Smt. Heera J. Shetty, No.1120/18 cross, HST 7th Sector, Bangalore -560102 Sub: Request for purchase of remaining land in Sy.no.74/27A1 of Bada village, Kaup Taluk - reg. Ref: 1) Your application dated 09.07.2025 Madam, 1 This has reference to your application cited above, wherein it is requested for purchase of remaining land in Sy.no.74/27A1 of Bada village, Kaup taluk. 2. In this regard, it is to inform you that, the 1.61 Cents land was acquired in Sy No 74/27A1 and 5.78 cents - 17 - HC-KAR NC: 2025:KHC:36887 WP No. 14786 of 2025 missed out by erroneously in the notification which needed for Right of way. 3. For maintaining the 30m ROW width (One Side), this office offered rates of Rs.2904.21 per sqm for your consent for an extent of 234sqm i.e. 5.78 cents for purchase through mutual consent. But it is noticed that you are not the agreed the offer rate so far. Hence, this office withdrawn the earlier offer given to you vide letter no.11039/2/2007/PIU(Mnglr)/453 dated 16.07.2024 submitted for purchase though consent. 4. As per present site condition, the remaining extent of land i.e. 5.78 cents (234sqm) proposed for consent award is not utilized for construction of four laning Highway, Hence, the remaining land of 5.78 cents is only required to maintain uniform width of ROW. Therefore, for remaining land acquisition authority will be preceded as per NH Act-1956 on requirement basis. This is for your information.” (Emphasis added) What is discernible from the chain of communications as quoted hereinabove is, Survey No.74/27A1, which belongs to the petitioners, was the subject matter of acquisition to a particular extent of 0.01.61 cents. The other area is utilized and the utilization is borne out in the communication. 11. The aforesaid is clearly indicative of the fact that, in the land of the petitioners, the NHAI have done the drainage work, footpath and also installation of lights. The - 18 - HC-KAR NC: 2025:KHC:36887 WP No. 14786 of 2025 communication is not denied by the respondents, but the justification is that, this has skipped from acquisition and therefore, it should be acquired, by way of compulsory purchase. The representation of the petitioners further is that, they are not wanting to sell the property, but the compensation to be paid, in terms of the law. This is again denied by respondent No.1 holding that as per the site condition, the remaining portion of the land, the acquisition authority will proceed on requirement basis, and was directed to submit a purchase proposal, through consent of the petitioners. 12. As observed hereinabove, these documents are enough circumstance to come to conclusion that the land of the petitioners has been utilized by laying a drainage, footpath and the street lights. The communication further is that, this land ought to have been the subject matter of acquisition, but it has become the subject matter of utilization, which cannot but be termed to be illegal utilization of a private property of a citizen. 13. It would not behove the status of the National Highway Authority of India, to utilise a land and come before the Court and contend that they have not utilised the land of - 19 - HC-KAR NC: 2025:KHC:36887 WP No. 14786 of 2025 the petitioners and in future, if they want, they would utilise the land by compulsory purchase. This is sans countenance. 14. In the light of the property of the petitioners being snatched away by utilisation without paying any compensation, the petition deserves to succeed. The endorsement dated 25.07.2022, stands quashed. 15. The respondents - National Highway Authority of India is direct calculate compensation, for utilising 0.07.39 cents without initiating any acquisition proceedings, in accordance with law, within an outer limit of twelve weeks from the date of receipt of a copy of the order. 16.
