This petition under Article 227 of the Constitution of India has been filed with a prayer to issue an order or direction, directing the Court of Additional Chief Judicial Magistrate, Court No.3, Varanasi to hear and decide the Complaint Case No.89801 of 2023 (Anil Kumar Rai vs. M/s Arpana Enterprises and another) within some stipulated period, which is pending since 18.07.2023, in the Court of Additional Chief Judicial Magistrate, Court No.3, Varanasi. Considering the fact that the trial has remained pending since 2023. Without expressing any opinion on the merits of the case, this petition is finally disposed of with a direction to the court concerned to decide the aforesaid case in the spirit of provisions of Section 143 (3) of Negotiable Instruments Act, as expeditiously as possible, without granting any unnecessary or long adjournments to either of the parties, if there is no other legal impediment.
