ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…to issue a writ, order or direction more particularly one in the nature of writ of Mandamus to declare the action of Respondent No. 1 in refusing to provide Police protection to the Petitioner and the agriculture land to an extent of Ac. 3-50 cents situated in Sy.No. 282 of Dekanakonda Village, Kurichedu Mandal, Prakasam District against the Respondent No. 3 and others as per judgment and decree in O.S. No. 208/2015 dated 29-03-2016 on the file of the Hon'ble Civil Judge, Darsi as arbitrary and illegal and violation of the Article 19 85 21 of Constitution of India and consequently, direct the Respondent No. 1 to provide Police Protection to the Petitioner as per the judgment and decree in O.S. No. 208/2015 dated 29-03- 2016 on the file of the Hon'ble Civil Judge, Darsi in the interest of justice..…”
2. Heard Sri P.Nagendra Reddy, learned counsel for the petitioner and Sri V.Farook, learned Assistant Government Pleader.

Learned counsel appearing for the proposed parties, who filed I.A. No.01 of 2023 seeking to implead them as respondents, submits that they are the owners of the subject property, without showing them as defendants, the petitioner filed the civil suit in O.S.No.208 of 2015 on the file of Junior Civil Judge, Darsi and obtained a decree. Learned counsel further submits that, pursuant to the interim orders passed by this Court directing Respondent No.1 to consider the complaint made by the petitioner on 13.09.2021, the police visited the site, conducted an enquiry, and found that possession of the

property is with the proposed parties/implead petitioners. Accordingly, the police did not give police protection in the matter.
4. Learned Assistant Government Pleader for Home seeks time to obtain fresh instructions in the matter.
5. Be that as it may, this Court cannot conduct a factual enquiry to determine who is in possession of the property. Accordingly, the Writ Petition is disposed of, leaving it open to the parties to work out their remedies before the appropriate forum, in accordance with law. There shall be no order as to costs.
As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed. _________________________________________
