Gupta, learned AGA for the State. 2. The sole prayer made in the present application is to direct the trial court to the expedite/ decide the Misc. Case No. 803 of 2022 (Vijay Singh Vs. Radha Devi and others) U/s 340 Cr.P.C. in Original Case No. 1635 of 2019 (Radha Devi Vs. Vijay Singh and others U/s 12, 17, 18, 20 and 22 of the D.V. Act, Police Station District" Rasoolabad, Kanpur Dehat. 3. Learned counsel for the applicant submits that the proceedings under Section 12, 17, 18, 20 and 22 of the D.V. Act stood initiated by the opposite party no. 2 against the applicant. Thereafter, an Application u/s 340 Cr.P.C. was preferred by the applicant, however the said proceeding are not decided. 4. Learned AGA submits that if any application/proceedings is preferred before the competent court then the same is to be decided strictly in accordance with law. 5. Considering the submissions so made across at bar, the application stands disposed of requiring the applicant to approach the court below while moving appropriate application/proceedings and, in case, such a proceedings is preferred then the court below shall decide the same strictly in accordance with law subject to legal impediment, if any.
