In furtherance of last order, learned counsel for petitioner on instructions seeks permission to withdraw this petition with liberty to raise all grounds as raised in the present petition before the trial court during final arguments. The order impugned in the present case was dismissal of the application under Order VII Rule 11 CPC and there having been no stay, the trial proceedings continued and have now reached the stage of final arguments.
