Neutral Citation No. - 2025:AHC:78955 Court No. - 1 Case :- CONTEMPT APPLICATION (CIVIL) No. - 2234 of 2025 Applicant :- Committee Of Management Janta Vaidic Inter College And Another Opposite Party :- Smt. Kavita Chaudhary, Principal, Government Girls Inter College And Another Counsel for Applicant :- Prabhakar Awasthi,Shiv Poojan Yadav Hon'ble Salil Kumar Rai,J. The present contempt application has been filed pleading willful disobedience of the order dated 18.3.2025 passed by this Court in Writ-C No. 592 of 2020. The operative portion of the order dated 18.3.2025 as incorporated in paragraph No. 6 of the order is reproduced below :- "6. Accordingly, considering the aforesaid facts of the case, this Court in the interest of justice directs the Joint Director of Education, Meerut Region, Meerut to appoint an Authorised Controller within a period of three weeks from the date of production of certified copy of this order. The Authorised Controller is further directed to hold the election of Committee of Management of the College within a period of three months from the date he assumes the charge of Authorised Controller." The applicant alleges willful disobedience of the order passed by this Court on the basis that the Authorized Controller appointed in the Institution has appointed the opposite party No. 2 as Election Officer and directed her to hold the elections. It is pleaded that the aforesaid is in disobedience of the order passed by this Court. The act of the opposite party No. 1 in appointing the opposite party No. 2 as Election Officer can not be termed as disobedience of the order passed by this Court so as to occasion proceedings under the Contempt of Courts Act, 1971. Any illegality in the elections if the appointment of opposite party No. 2 as Election Officer is considered to be contrary to the order passed by this Court would be a ground for the applicant to challenge the same in any proceedings challenging the elections. It is not a case for registering proceedings under the Contempt of Courts Act, 1971. The contempt application is dismissed.
