IA NO: 1 OF 2024 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to direct the Respondents No.1 to 4 not to disturb the personal liberty of the Petitioner by summoning the Petitioner to the Police Station on the ground of pendency of the Rowdy Sheet No. 19 in the Respondent Police Station, pending disposal of the writ petition in the interest of justice. ORDER
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…to issue a writ, order or direction more particularly one in the nature of writ of Mandamus to declare the action of the Respondents No.1 to 4 in opening the Rowdy Sheet No.19 against the Petitioner and maintaining the same in the 1st Respondent Police Station on the ground that the Petitioner is involved in one Crime and disturbing the personal liberty of the Petitioner as is arbitrary and illegal and violation of Article 14 and 21 of the Constitution of India and consequently direct the Respondents No.1 to 4 to close the Rowdy Sheet No. 19 pending against the Petitioner in the 1st Respondent Police Station forthwith in interest of justice…”
2. Heard Sri P.Nagendra Reddy, learned Counsel for the Petitioner and Sri V.Farooq, learned Assistant Government Pleader for Home for the respondents.

Learned counsel for the Petitioner would submit that a single case is pending against the petitioner for the offence punishable under Section302 of IPC.
4. Learned Assistant Government Pleader would submit that in the light of the case of murder which is pending against the petitioner, the petition may be dismissed.
5. Considering the submissions made, the Writ Petition is disposed of. However, the Police are directed to follow the procedure directed by the Division Bench of this Court in its order dated 12.09.2022 in I.A.No.1 of 2022

in Writ Appeal No.674 of 2022, for summoning the petitioner to the police station on account of the pending rowdy sheet. No order as to costs.
