1. A Joint Memo is filed in which the petitioner has undertaken to pay a sum of Rs.1,30,000/- as full and final settlement of the respondent – complainant’s claim. 2. It is also stated that the said amount would be transferred to the account of the respondent – complainant on or before 30.04.2025 and failing which the petitioner has undertaken to pay interest at the rate of 18% per annum from
30.04.2025. 3. The amount of Rs.12,000/- deposited by the petitioner – accused before the learned Magistrate shall be permitted to be withdrawn by the petitioner - accused after 30.04.2025, subject to furnishing proof of the transfer of Rs.1,30,000/-, as undertaken in the Joint Memo. - 4 -

Upon the intervention of the common friends of the Petitioner and the Respondent, the Petitioner and the Respondent have decided to amicably settle the subject matter of dispute in the above case on the following terms:
1. That the Petitioner undertakes to pay the Respondent a sum of Rs.1,30,000/- (Rupees One Lakh Thirty Thousand Only) towards the full and final claim of the Respondent/ Complainant in the above case. 2. The Petitioner undertakes to transfer the sum of Rs.1,30,000/-(Rupees One Lakh Thirty Thousand Only) to the savings bank account No. 20070505385 maintained with M/s. State Bank of India, Gunjur Branch, Bengaluru, IFSC code: SBIN0061775 in the name of the Respondent/Complainant i.e. VINODKUMAR PARANJI SRIRAMA on or before the 30th day of April, 2025. 3. For any reason if the Petitioner/ Accused fails to deposit the amount in the above ________________________________________________________________ Sd/-

- 6 - mentioned manner within the specified timeframe, the Petitioner undertakes to repay the amount of Rs.1,30,000/- (Rupees One Lakh Thirty thousand Only) along with interest calculated at the rate of 18% p.a. calculated from the date of default i.e. from 30/04/2025. 4. The Petitioner/ Accused has deposited a sum of Rs.12,000/-(Rupees Twelve Thousand Only) before the XXXIII Additional Chief Metropolitan Magistrate, Mayohall in CC No. 56243/2019. It is respectfully prayed that the said amount in deposit be released in favour of the Petitioner/ accused Counsel upon the accused furnishing proof of payment in favour of the Respondent/ Complainant as mentioned above. 5. In case of default the Respondent/ Complainant is at liberty to recover the Amount due along with the penalty as agreed upon by initiating necessary proceedings before the Jurisdictional Court of Law. 6.
This Joint memo is being filed with the free volition and full faculty of mind and without any force, coercion and duress and both the parties agree to adhere to the terms and conditions mentioned above. WHEREFORE, the Petitioner and Respondent prays that this Hon'ble Court may be pleased to pass appropriate orders based on this joint memo filed by the complainant and accused reporting the terms of the settlement in the above matter IN THE INTEREST OF JUSTICE.
