Neutral Citation No. - 2025:AHC:144968 Court No. - 83 Case :- CRIMINAL APPEAL No. - 4448 of 2025 Appellant :- Awadhesh Kumar Respondent :- State Of U.P. And 2 Others Counsel for Appellant :- Ghan Shyam Das,Sr. Advocate Counsel for Respondent :- G.A.,Sanjay Kumar Srivastava Hon'ble Shekhar Kumar Yadav,J.
1. Heard learned counsel for the applicant, learned AGA for the State and perused the record.
2. This Criminal Appeal under Section 14(A) (2) of SC/ST Act has been filed against the order dated 07.01.2025 passed by Addl. Sessions Judge/Special Judge, SC/ST Act, District Kannauj in Bail Application No. 2246 of 2024 (Dr Rishabh Yadav and another Vs State) in S.T. No. 915 of 2024 arising out of Case Crime No. 321 of 2024, under Sections 323, 504, 506 IPC, Section 3(1) da of SC/ST Act, P.S. Kotwali Chhibramau, District Kannauj whereby the opposite parties no. 2 & 3 have been granted bail by the trial court.
3. The law with regard to cancellation of bail has been well settled by a catena of judgements holding that cancellation of bail can be ordered only on stronger grounds and bail already granted should not be cancelled unless it appears that the order granting bail is arbitrary, illegal and perverse or if the accused is interfering with the course of justice by tampering with the evidence. It is also trite law that the power to cancel bail has to be exercised with caution and great circumspection in appropriate cases.
4. Learned counsel for the applicant could not show any cogent and overwhelming circumstances for cancellation of bail granted to respondent nos. 2 & 3 .
5. Considering the facts and circumstances of the case and the well settled legal principles regarding cancellation of bail once granted, this Court does not find any ground to cancel the bail of the accused-respondent.
6. Accordingly, the present criminal appeal lacks merit and is hereby rejected. Order Date :- 22.8.2025/RavindraKSingh Digitally signed by :- RAVINDRA KUMAR SINGH High Court of Judicature at Allahabad
