Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ Order of direction particularly, one in the nature of Writ of Mandamus declaring the action of the respondents in keeping pending the Mutation Application of the petitioner for Mutation the names of land in Survey Nos. 226/7 (0.88 cents), 226/8 (0.68 cents), 226/9 (0.01 cent), and 226/12 (0.11 cent), total extent 01.68 cts, situated in T.R. ORDER:
The present Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:
“…to issue a Writ Order or direction particularly, one in the nature of Writ of Mandamus declaring the action of the respondents in keeping pending the Mutation Application of the petitioner for Mutation the names of land in Survey Nos.226/7 (0.88cents), 226/8 (0.68cents), 226/9 (0.01cent) and 226/12 (0.11cents), total extent 01.68 cents, situated in T.R. Kandriga village, Nagari Mandal, Chittoor District, as per title/registration and mutation documents dated 24/10/1981 and 27/04/1987 despite the petitioner had paid requisite fee vide its Mutation Application No vide MUT241231047786, paid fee of Rs. 100/- more than 30 days is contrary to the Sec 5 (1) proviso of Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971 as illegal, arbitrary and violation of principles of natural justice and also Article 14,19,21 and 300-A of the Constitution of India and consequently direct the respondent No.3 to dispose the Mutation Application No.MUT241231047786, Dated 31-12- 2024 and pass such order or orders may deem fit and proper in the circumstances of the case”.
2. The present writ petition is filed seeking a direction to address the mutation application filed by the petitioner for mutating the name of the petitioner in the revenue records.
3. The learned Assistant Government Pleader would submit that the application filed by the petitioner under Section 6 of the A.P. Rights in Land and Pattadar Passbooks Act 1971, was rejected on 17.04.2025, as such, the writ petition has become infructuous.
4. In view of the submission made by the learned Assistant Government Pleader and since the mutation application of the petitioner was disposed, without going into merits of the case, this
4 Court is inclined to dispose of the writ petition directing the 3rd respondent/Tahsildar to communicate the rejection order dated 17.04.2025 to the petitioner within a period of three weeks from the date of receipt of a copy of this order.
5. Accordingly, the Writ Petition is disposed of. There shall be no
order as to costs.
