CRL.M.C. 7202/2025 $~64 * IN THE HIGH COURT OF DELHI AT NEW DELHI # CNR No. DLHC010774032025 + CRL.M.C. 7202/2025 & CRL.M.A. 30255/2025 SEEMA SHARMA & ORS. .....Petitioners Through: Mr. Jitesh Talwani, Advocate alongwith petitioners on video conference. versus STATE OF NCT OF DELHI & ANR. .....Respondent Through: Mr. Tarang Srivastava, APP with Mr. Abhay Saini, Advocate. SI Sonu Kumar, PS-Vivek Vihar. Mr. Utkarsh Pandey, Ms. Rajshri Menghani, Advocates for R2 alongwith R2 - complainant in person. CORAM: HON’BLE MR. JUSTICE PRATEEK JALAN O R D E R % 05.08.2026 1. By way of this petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioners seek quashing of FIR No. 194/2018, dated 12.04.2018, registered at Police Station Vivek Vihar, District Shahdara, Delhi, under Sections 406/420/120B of the Indian Penal Code, 1860, on the basis of a mediated Settlement Agreement dated 22.09.2018. 2. It is an admitted position that the Settlement Agreement contemplated payment of a sum of Rs. 15,50,000/- by petitioner No. 1 to respondent No. 2 – complainant, in various instalments, between 15.10.2018 to 15.10.2021. However, I am informed that the installments were not paid in time, and some of the cheques were also dishonoured. This is a digitally signed order. It is contended by Mr. Jitesh Talwani, learned counsel for the petitioners, that the entire sum of Rs. 15,50,000/- has now been paid to the complainant. However, Mr. Utkarsh Pandey, learned counsel for the complainant, upon instructions from the complainant, who is also present in Court, disputes this position. 4. Be that as it may, I am of the view that this petition, in any event, cannot succeed on the basis of a settlement that was entered almost eight years ago, which was also not honoured in full. 5. The petition, alongwith pending application, is therefore dismissed. 6. However, learned counsel of the parties, submit that they would like to make an attempt to arrive at a new settlement, which the petitioners will endeavour to satisfy in a single instalment of payment. 7. For the aforesaid purpose, the parties are referred to Samadhan, Delhi High Court Mediation and Conciliation Centre, Sher Shah Road, New Delhi – 110503. 8. The parties will appear before the learned Mediator on 17.08.2026. 9. The parties are at liberty to approach the Court afresh, if they arrive at a fresh settlement, after it is fully implemented. 10. It is made clear that the proceedings before the Trial Court can continue, subject to any further orders by this Court, in the event a new settlement is arrived at between the parties.
