.2025 Heard Ms. J. Paul, learned counsel for the applicant and also heard Ms. R.D. Mozumdar, learned counsel for the respondent No.1. This application under Section 5 of the Limitation Act is preferred by the applicant for condonation of delay of 9 days in preferring the connected appeal against the
judgment and award dated 01.10.2024 passed by the learned Member, Motor Accident Claims Tribunal (MACT) No.3, Kamrup(M), Guwahati, in MAC Case No.1921/2018. Ms. Paul, learned counsel for the applicant submits that on account of ill health of the applicant and also due to poor financial condition, the appeal could not be filed in time and the delay is not intentional, rather the same is circumstantial and under such circumstances, it is contended to allow this application. Ms. Mozumdar submits that she has no objection in the event of condoning the delay of 9 days. Taking note of the submission of learned counsel for both the parties and also considering the explanation so forthcoming for the delay of 9 days in preferring the
Page No.# 3/3 connected appeal, this Court is of the view that the delay is sufficiently explained and as such, the same stands condoned. In terms of above, this I.A. stands disposed of.
