1. Mr. Mehboob Rahi, learned counsel for the applicant.
2. Mr. V.S. Pal, learned A.G.A. with Mrs. Meenakshi Sharma, learned Brief Holder for the State.
3. The present applicant ‘Joga Singh’ is praying for regular bail in relation to First Information Report dated 09.02.2025 bearing FIR No. 0042 of 2025 P.S. Nanakmatta, District Udham Singh Nagar, which was lodged for the offence punishable under Section 309(4) of BNS, 2023 against some unknown persons.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated and there is no recovery of stolen items from the applicant’s possession and the applicant have no previous criminal history.
5. On the other side, learned A.G.A. Mr. V.S. Pal on written instructions submits that there is recovery from the present applicant and there is also the recovery from the other co-accused persons namely Zubair and Ali Jamaw. He submits even Zubair and Ali Jamaw were not named in the FIR and the applicant’s name was disclosed by other two persons.
6. After hearing the arguments of learned counsel for the parties and further taking into
consideration the allegations alleged in the FIR and the written instructions as placed by the learned A.G.A., this court is of the view that the applicant does not deserve for bail.
7. Accordingly, the bail application is rejected. .
