JUSTICE SACHIN SHANKAR MAGADUM ORAL ORDER This petition is filed by accused Nos.2 and 3 seeking quashing of the proceedings pending in C.C.No.60871/2024 for the offence punishable under Section 420 of IPC and Section 4 of Karnataka Prohibition of Charging Exorbitant Interest Act. 2. Today, an application has been filed under Section 320 of the Code of Criminal Procedure, seeking compounding of the offence on the ground that the matter has been amicably settled between the parties outside of Court. Respondent No. 2/complainant, who is present before this Court, on being queried, has admitted that the dispute has been resolved amicably and, accordingly, has requested this Court to quash the proceedings pending in CC No. 60871/2024. - 3 - HC-KAR NC: 2025:KHC:35377 CRL.P No. 9513 of 2024 Upon further inquiry, this Court notes that Respondent No. 2/complainant has not raised any allegation of coercion, pressure, or undue influence in arriving at the settlement. Since the complainant has voluntarily decided to withdraw all allegations, and in the interest of preventing abuse of the judicial process, this Court is of the view that it is just and proper to quash the proceedings in the said case. 3. Accordingly, this Court passes the following: ORDER (i) The petition is allowed. (ii) The proceedings pending in CC No. 60871/2024 on the file of the X Additional Chief Metropolitan Magistrate, Mayo Hall, Bengaluru, for the offences punishable under Section 420 of the Indian Penal Code and Section 4 of the Karnataka Prohibition of Charging Exorbitant Interest Act, are hereby quashed.
