The present application u/s 528 BNSS has been filed with a prayer to issue a direction to the trial court to release the applicant in six cases after submitting personal bond and two sureties, which are as under :- (i) Case Crime No. 399 of 2024, under Section 303(2) of BNS, Police Station Sadar Bazar, District Saharanpur. (ii) Case Crime No. 403 of 2024, under Section 379 of IPC, Police Station Sadar Bazar, District Saharanpur. (iii) Case Crime No. 285 of 2024, under Sections 379, 420 and 465 of IPC, Police Station Sadar Bazar, District Saharanpur. (iv) Case Crime No. 337 of 2024, under Section 379 of IPC, Police Station Sadar Bazar, District Saharanpur. (v) Case Crime No. 404 of 2024, under Sections 303(2), 318(4), 336(2) of BNS, Police Station Sadar Bazar, District Saharanpur. (vi) Case Crime No. 268 of 2024, under Section 379 of IPC, Police Station Sadar Bazar, District Saharanpur. Learned counsel for the applicant submitted that applicant has been protected in anticipatory bail application till conclusion of trial in all six cases. It is further submitted that the applicant is a poor person and he has no means to submit sureties as ordered in bail orders. Applicant has been roped up in six cases in a row. It is further submitted that all the cases are same in nature. It is further submitted that all six cases are related to Police Station Sadar Bazar, District Saharanpur. It is further submitted that applicant has been granted bail in all six cases. In view of the above facts and circumstances, the concerned Magistrate is directed to release the applicant in all six cases related to Police Station Sadar Bazar, District Saharanpur on the basis of personal bond of Rs.1,00,000/- and two sureties of like amount to the satisfaction of court concerned.
