GP FOR SERVICES I The Court made the following: 2 THE HON’BLE SRI JUSTICE NYAPATHY VIJAY W.P.No.27459 of 2025 O R DE R: The present Writ Petition is filed questioning the Transfer Proceedings in Rc.No.458/12/2025, dated 30.08.2025 issued by the Respondent No.4 as illegal and arbitrary. 2. The Petitioner was initially appointed as Multi Purpose Health Assistant (F) on 05.01.1996 and thereafter she was promoted as Health Educator in the year 2007. It is stated that the Petitioner has been working as Health Educator in Tribal Area/Agency Area for the last 19 years. Under the impuged Order of Transfer, the Petitioner was transferred from Jiyyammavalasa P.H.C to Sambara P.H.C, which is a remote village in the Agency Area. 3. Learned counsel for the Petitioner submits that the Petitioner has been continuing in the Agency Area for more than 19 years and the continuation of the Petitioner in the Agency Area is not in consonance with the Transfer Policy. It is stated in the affidavit that the Petitioner had lost her son due to Cerebral Malaria Disease, which is prevailing in the Agency 3 Area. 4. Learned Assistant Government Pleader on instructions submits that the representation of the Petitioner dated 3.09.2025 would be examined by the Respondent Authorities and pass appropriate orders will be passed. 5. Considering the fact that the Petitioner has been continuing in the Agency Area for the last 19 years and had lost her son due to Cerebral Malaria Disease, which is prevalent in the Agency Area, the Writ Petition is disposed of with following directions: i) The Respondents are directed to consider the representation of the Petitioner dated 03.09.2025 for posting the Petitioner in Non Agency Area as expedituously as possible, preferably within a period of eight weeks from today on humaniterian grounds. ii) Till the representation of the Petitioner is considered, the Petitioner shall be continued at Jiyyammavalasa PHC. iii) There shall be no order as to costs. 4 As a sequel, miscellaneous petitions, pending if any, shall stand closed. __________________ NYAPATHY VIJAY, J Date: 10.10.2025 eha 5 THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION NO: 27459/2025 Dt. 10.10.2025 eha
