ORAL ORDER
1. The petitioner is before this Court seeking for the following reliefs: (a) ISSUE A WRIT OF MANDAMUS OR ANY OTHER APPROPRIATE WRIT, ORDER OR Direction or Directing the respondents No: 1 and 2 herein to execute the registration / Register documents of the schedule property in the name of the Petitioner herein, in respect of the House No: 164, New No: 164/395, LHC Quarters, situated Silk Filature Labour Colony. Byrapura Extension, T. Narasipura, Mysuru District.
(b) ISSUE A WRIT OF MANDAMUS OR ANY OTHER APPROPRIATE WRIT, Order or Direction or Directing

the respondents No 1 and 2 herein to consider the representations given by the Petitioner herein, in respect of the House No: 164, New No: 164/ 395, LHC Quarters, situated Silk Filature Labour Colony, Byrapura Extension, T. Narasipura, Mysuru District. To take necessary actions in this regards for effecting the registration in favour of this inriocent Petitioner nerein At: Annexure ZB.
(c) Allow the petition with cost.
(d) Call for records and pass such other order as this hon'ble court deems fit in the above said circumstance in the interest of justice and equity.

The claim of the petitioner is that her adoptive mother had been allotted KHB Quarters bearing House No.164, Byrapura Extension, T.Narasipura and all the payments had been made by the adoptive mother. The representation which had been submitted for registration of a sale deed in her name, not having been acted upon, the petitioner is before this Court seeking for the aforesaid reliefs.

Learned counsel for respondent No.3 submits that the petitioner is not entitled to any sale to be registered in her favour and that respondent No.3 has objections. Even if that be so, it is for respondent No.3 to submit the necessary objections to respondent No.1 for the purpose of consideration of those objections, the representation

having been submitted by the petitioner way back in the year 2001, not having been considered.
4. Though the submission of Sri. P.B.Achappa, learned counsel for respondent Nos.1 and 2 is that neither petitioner nor respondent No.3 would be entitled to the said house, the fact remains that respondent Nos.1 and 2 have not passed any order. In that view of the matter, I pass the following:
ORDER i) The writ petition is allowed. ii) A mandamus is issued directing respondent Nos.1 and 2 to consider the representation of the petitioner and the objections of respondent No.3 and pass necessary orders as expeditiously as possible. iii) Respondent No.3 is granted 15 days' time from today to file his statement of objections. If objections are not filed, respondent Nos.1 and 2 are directed to proceed with the consideration of the application filed by the petitioner, as there is no objection available.

iv) Respondent Nos.1 and 2 are directed to pass necessary orders within a period of 45 days of the receipt of the objections and/or within a period of 45 days from the date of expiry of 15 days from the date of this order.
