Subsequently, the Police altered the Section of offence from 194 of ‘the BNSS’ to Sections 108, 318(2) and 318 (4) of ‘the BNS’. 2. The case of the prosecution is that on 23.08.2025 at about 17:30 hours, the complainant reported that she, along with her son, has been residing at Ashok Nagar, Kancharapalem, Visakhapatnam. She owns a two-storied house at Kobbarithota, Visakhapatnam, wherein one Sateesh resides on the top floor, and the ground floor was rented to a couple named Naresh and Ramya on 14.08.2025 through a mediator, Bharathi of Kobbarithota. Meanwhile, on 23.08.2025 at about 12:50 hours, her son Rajesh received a phone call informing him that Ramya had died by hanging herself with a chunni in the house at Kobbarithota. Immediately, the complainant rushed to Kobbarithota and found Ramya hanging from the ceiling fan hook with a chunni. She came to know that Ramya and her husband had a quarrel, and Ramya might have committed suicide due to those disputes with her husband. Sri G.Maheswara Rao, the learned counsel for the petitioner contends that the petitioner is innocent of the alleged offence and he has been falsely implicated by the police. It is further submitted that the petitioner is the sole earning member of the family and, therefore, his incarceration would cause undue hardship to his dependents. The petitioner undertakes to strictly adhere to any conditions that may be imposed by this Court. In light of the foregoing submissions, learned counsel prays that the present petition be allowed in the interest of justice. 4. Per contra, Ms.P.Akhila Naidu, the learned Assistant Public Prosecutor vehemently opposed to grant of bail to the petitioner, submitting that the investigation is still underway and several material witnesses remain to be examined. It is contended that if the petitioner is released on bail at this stage, there is a strong likelihood that he may abscond, thereby hampering the ongoing investigation and evading the process of law. In view of the foregoing submissions, it is urged that the petition be dismissed. 5. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor. The learned Assistant Public Prosecutor submits that so far, five witnesses have been examined, and the investigation is at a nascent stage. It is stated that the petitioner earlier had an affair with the de facto complainant but later married another woman. After some time, he got back in touch with the deceased and continued his relationship with her. The deceased wrote a suicide note and ended her life. 7. Considering the facts and circumstances of the case and in view of the pendency of the investigation, this Court is not inclined to grant bail to the petitioner/Accused at this stage. Hence, this Criminal Petition is liable to be dismissed. 8. In the result, the Criminal Petition is dismissed. As a sequel, Miscellaneous petitions, if any pending, shall stand closed. _________________________ DR. Y.
