HC-KAR NC: 2025:KHC:38974 CRL.P No. 10792 of 2025 SC & ST (Prevention of Atrocities) Act, 1989 and Sections 351(3), 352, 74, 85 of BNS, 2023.
2. Today, a joint memo has been filed by the first petitioner/husband and the second respondent/wife. The second petitioner/mother-in-law is also present before this Court. In the joint memo, it is indicated that the second respondent/wife has resolved her differences with her husband and has rejoined the marital home of the first petitioner/husband.
3. In view of the amicable settlement and the fact that the wife has rejoined the marital home, this Court is inclined to grant indulgence. Considering the reconciliation of the parties, continuation of the proceedings under Section 498A IPC may amount to an abuse of process of law. To secure the ends of justice and to bring a quietus to the marital discord which led to registration of the crime, this Court finds it appropriate to exercise its inherent jurisdiction under Section 482 of the Cr.P.C.
