The Court :- Appeal is directed against an order dated July 16, 2025 passed in WPO/460/2025. By the impugned order the learned Single Judge dismissed the writ petition on the ground that, various documents of the appellant contain various dates of birth. Learned advocate appearing for the appellant submits that, the date of birth recorded in the Birth Certificate should be taken as sacrosanct. The authorities should be directed to verify the date of birth or the authenticity of the Birth Certificate and proceed with the renewal of the passport. None appears for the respondent authorities. In the facts and circumstances of the present case, it appears that the appellant gave different dates of birth to different authorities. There is a 2 mismatch between the date of birth in the passport and that in the documents issued by various authorities. There is also a mismatch between the date of birth appearing in the Birth Certificate with that of the date of birth recorded in the School Leaving Certificate as well as other documents. In such circumstances, till such time clarity with regard to the date of birth of the appellant is not established by a process known to law, passport authorities should not be called upon to renew the passport. In such circumstances, we find no merit in the present appeal. APO/62/2025 is dismissed without any order as to costs. (DEBANGSU BASAK, J.) (MD. SHABBAR RASHIDI, J.) A/s.
