IN THE HIGH COURT OF ORISSA AT CUTTACK W.P.(C) No.25666 of 2025 Narayan Bhoi …. Petitioner Mr. K.A. Guru, Advocate -versus- State of Odisha and Others …. Opp. Parties Mr. S.P. Das, ASC CORAM: JUSTICE BIRAJA PRASANNA SATAPATHY Order No ORDER 16.09.2025 01. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical) Mode. 2. Heard learned counsel for the parties. 3. The present Writ Petition has been filed inter alia challenging order of transfer issued by the Govt. in the Panchayati Raj Department on 04.09.2025 under Annexure-2. Petitioner as per the order has been put under transfer from Baripada to Bargarh. But in course of hearing, it is contended that petitioner is ready and willing to join in his place of transfer. 3.1. However, it is contended that taking into account suffering of the petitioner and his treatment, petitioner be allowed to discharge his duty in the office instead of doing duty in the field. It is accordingly contended that petitioner be given liberty to move an application after his joining, to assign him duty in the office instead of doing duty in the field. 4. Learned Addl. Standing Counsel has no serious objection to the course of action proposed by the learned counsel for the petitioner. 5. Having heard learned counsel for the parties and considering the submissions made, this Court while disposing the Writ Petition, permits the petitioner to move the authority concerned in his place of joining for consideration of his grievance to be attached to the office instead of doing duty in the field if so permissible. It is observed that if any such application will be moved, the same be considered taking into account the grounds of such application in accordance with law. 6. With the aforesaid observation, the Writ Petition stands disposed of. (Biraja Prasanna Satapathy) Judge Basudev
