Petitioners have filed this writ petitioner under Article 226 of the Constitution of India, seeking following reliefs:- “10.1 That this Hon’ble Court may kindly pleased to direct the respondent authorities to forthwith compute the compensation in lieu of acquired land of petitioners according to present market value of land and pay the same to the petitioners, with interest from the date of taking possession to its realization, as per Section 11,26,28,30 & 80 of New Act, 2013. 10.2 That any other relief/order which may deem fit and just in the facts and circumstances of the case including award of the cost of the petition may be given.” 2. Learned counsel for petitioners submits that the land of the petitioners is affected due to construction of road from Jarve Umreli to Lakshanpur Chowk, however, no proceedings for acquisition of land of petitioner was initiated nor any compensation has been paid. Petitioner has submitted representation before respondent no. 2 and 3 however, till date representation is also not considered and decided and therefore, direction be issued to respondent no. 2 and 3 to take decision on pending representation. 3. Learned counsel for the State would submit that in view of limited prayed made by counsel for petitioner, he is having no objection. However he submits that representation which is stated to have been filed by petitioners does not bear receipt seal and therefore, it is not reflecting that the representation placed on record is whether submitted before the concerned authority or not. 3 4. I have heard learned counsel for the parties and perused the documents enclosed along with this writ petition. 5. On due consideration of submission made by learned counsel for the respective parties and further considering the nature of grievance raised by petitioners by way of this petition, I find it appropriate to dispose of this writ petition at this stage permitting petitioner to submit fresh representation before respondent no. 2 to 5, and if such a representation is submitted, concerned authorities shall consider and decide the same, in accordance with law, expeditiously, preferably within a further period of 02 months from the date of receipt of the representation. 6.
