IN THE HIGH COURT OF ORISSA AT CUTTACK
W.P.(C) NO.25733 OF 2025
C.B. Degree Mahavidyalaya, Garhsanput, Puri …. Petitioner Mr. A. Swain, Advocate
-versus-
State of Odisha & Others …. Opp.Parties
Mr. D. Lenka, AGA
CORAM:
HON’BLE MR. JUSTICE DIXIT KRISHNA SHRIPAD
ORDER
Order No.
01. 16.09.2025
The short grievance of the Petitioner is aired in the text of the prayer column, which is as under:
“Under the aforesaid facts and circumstances of the case, it is therefore, prayed that this Hon'ble Court may graciously be pleased to issue a writ of mandamus by quashing the letter vide no.5953 issued on dtd.03.09.2025 by the opp. Party no.3under Annexure-6 respectively. And further be pleased to direct the opp. Parties to ensure the smooth functioning of the Governing Body as well as the ChoudamoujaBidyut (CB) Degree Mahavidyalaya.”
2.
Learned counsel for the Petitioner submits that dissolution of a popular Governing Body mid way is a serious thing and that is not permissible under Section 7 of Odisha Education Act, 1969, subject to all exceptions. He further submits that in view of threat of dissolution, his client needs to be protected by this Court. In support of that, he draws attention of the Court to the letter dated 03.09.2025 issued by the Regional Director, Regional Directorate of Education at Annexure-6.
3. Learned AGA-Mr. Lenka appearing for official OPs opposes the petition contending that the petition is misconceived and that what has
been directed in the subject letter is only holding of inquiry with the participation of stakeholders and nothing beyond that.
4. Having heard learned counsel for the parties and having perused the petition papers, this Court broadly agrees with the submission made by learned AGA-Mr. Lenka. The same is supported by the text of letter dated 03.09.2025, which is as under:
“I am to inform you that an inquiry in to the matter will be conducted by Dr. Jitendra Sahoo, Regional Director of this Directorate on 18.09.2025 at C.B. Degree Mahavidyalaya (+3 Degree College), Garhsanput, Kanas, Puri at 11.00 AM. Therefore, you are requested to inform all the staff members and Governing Body Members of your college to remain present in the scheduled date and time.”
In the above circumstances, writ petition is disposed off without prejudice to contention of the Petitioner and other stakeholders in the subject inquiry that shall be accomplished within a period of eight weeks.
Now, no costs.
Web copy of this order to be acted upon by all concerned.
