HC-KAR NC: 2025:KHC:26242 CRL.P No. 9104 of 2025
No.53558/2013. Since coercive steps have been taken in respect of the petitioner to secure his presence, he had approached the jurisdictional Sessions Court in Crl.Misc.No.25445/2025 which was rejected on 26.06.2025. Therefore, he is before this Court. 4. Undisputedly, on the merits of the case, petitioner was earlier granted regular bail after he was arrested in Crime No. 20/2012 registered by Bethamangala Police Station, Kolar. For want of jurisdiction, FIR was subsequently transferred to K. R. Puram Police Station, Bengaluru, and after completing investigation, charge sheet was filed by K. R. Puram Police Station, Bengaluru and the case is now pending before the Court of Magistrate in CC No.53558/2013. According to learned counsel for the petitioner, after the case was transferred to K. R. Puram Police Station, Bengaluru, petitioner had no notice and even summons was not served on him from the Trial Court. It is under these circumstances, he had not appeared before the Court. Be that as it may, the fact remains that petitioner was earlier granted regular bail in the present case by the jurisdictional Court.
Since it is the contention of the petitioner

that after the FIR was transferred to K. R. Puram Police Station, Bengaluru, he had no notice and even summons was not served on him by the jurisdictional Court of Magistrate, I am of the opinion that this petition can be disposed of reserving liberty to the petitioner to file necessary application before the jurisdictional Court to recall the NBW issued against him and also seek regular bail. Accordingly, the following order:-
5. The petition is disposed of with liberty to the petitioner to appear before the jurisdictional Court of Magistrate in CC No.53558/2013 and file necessary application seeking to recall NBW issued against him and to release him on bail. If such applications is filed by the petitioner, the same shall be considered and disposed of on merits by the jurisdictional Magistrate on the same day. Sd/- (S VISHWAJITH SHETTY) JUDGE
