This petition filed by the petitioner seeking appointment of Arbitrator to decide the dispute that has arisen between the parties as per the provisions of the Arbitration and Conciliation Act, 1996 under Clause-28 of Primary Logistics Transport Solutions Agreement dated 01.01.2020 at Annexure- B. 3. Having heard the learned counsel for the petitioner, and on perusal of Clause-28 of the Primary Logistics Transport Solutions Agreement dated 01.01.2020 (Annexure-B), I am of the view that, the petitioner has made out a case for appointment of Arbitrator for resolution of the dispute between the parties. 4. In that view of the matter, Sri Vishweshwara Bhat, retired District Judge, is appointed as Arbitrator for resolution of the dispute between the parties. The Sole Arbitrator is - 6 - HC-KAR NC: 2025:KHC:35166 CMP No. 352 of 2024 appointed to adjudicate the dispute between the parties at the Arbitration and Conciliation Centre, Bengaluru. Accordingly, Civil Miscellaneous Petition is disposed of. 5. All claims and contentions of the parties are kept open to be decided by the Arbitral Tribunal. 6. A copy of this order be sent forthwith to the Arbitration and Conciliation Centre (Domestic & International), Khanija Bhavan, Bengaluru for proceeding further in the matter. 7.
