Gill, Advocate, accepts notice on behalf of respondent No.3. They have no objection against the prayer made in the application. MAIN CASE Innocuous prayer made in the present petition is that a reference petition under Section 28-A of the Land Acquisition Act, 1894 (hereinafter to be referred as “the Act”), filed at the instance of petitioner- landowner, is not being adjudicated upon by the Land Acquisition Collector, Rohtak (for short “LAC”). [2] Having heard learned counsel for the parties; without commenting upon the controversy in the matter and in view of the entitlement of petitioner qua the compensation amount, respondent No. 2- LAC is directed to dispose off the petition under Section 28-A of the Act (Annexure P-1), filed at the instance of petitioner-landowner, as early as possible preferably within a period of three months from today. [3] Disposed off accordingly. [4] The aforesaid direction is being issued while considering the fact that the petition under Section 28-A of the Act is pending consideration with the authority concerned for the last more than five years. [5] The above observations may not be construed as an expression of opinion on the merits of the case in any manner. [6] Pending miscellaneous application(s), if any, shall also stand disposed off.
