JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, the petitioners have sought for the following relief: "a. Quash the Impugned Complaint dated 19.06.2021 (Annexure-B) filed by Respondent No.2 and Impugned FIR dated 19.06.2021 (Annexure-A) in Crime No.132/2021 registered by the Respondent No.1 in relation to offences under Sections 428, 429, 503, 504,506,507,509 r/w 34 of the Indian Penal Code, 1860; b) Quash the charge sheet dated 04.10.2021 (Annexure-C) filed by Respondent No.1 Police in relation to offences under Sections 504, 506, 509 r/w 34 of the Indian Penal Code, 1860, and consequently quash all further proceedings pursuant thereto in C.C.No.35139/2021 pending on the file of the 7th Addl. ACMM Court, Nrupatunga Road, Bangalore City (Annexure-D)." 2. Heard the learned counsel for the petitioner Nos.1 and 3 and learned counsel for the petitioner No.2 as well as the respondent No.2-party-in-person, who is physically present and perused the material on record. - 4 - HC-KAR NC: 2025:KHC:25949 CRL.P No. 3245 of 2022 3. Respondent No.2-Party-in-person, who is physically present submits that subsequent to the incident in question, respondent No.2 has vacated the premises and as such she has no objection for the impugned FIR and charge sheet to be quashed subject to the condition that the petitioners undertake that they will not harass or trouble the Monkeys or Dogs or other animals in future. 4. Per contra, learned counsel for the petitioners jointly submits that without prejudice to the rights and contentions and without admitting the allegations made against them by respondent No.2, the petitioners would undertake that they will not henceforth harass or trouble any animals including Monkeys or Dogs etc. 5. In view of the aforesaid facts and circumstances and the joint submission made by both sides, I deem it just and appropriate to quash the impugned proceedings and by recording the undertaking given on behalf of the petitioners. - 5 - HC-KAR NC: 2025:KHC:25949 CRL.P No. 3245 of 2022 6. In the result, I pass the following ORDER (i) The petition is hereby allowed. (ii) The impugned FIR dated 19.06.2021 in Crime No.132/2021, charge sheet dated 04.10.2021 and all further proceedings in C.C. No.35139/2021 pending on the file of the VII Addl.C.M.M.
