Applicant has filed this application under Section 447 of B.N.S.S., 2023 seeking transfer of S.T. No.152 of 2024, titled State Vs. Vishal Sonkar and another, arising out of case crime no.503 of 2023, under Sections 376, 504 IPC and 66 I.T. Act, Police Station Line Bazar, District Jaunpur, Pending in the court of Additional Session Judge/F.T.C. Ist (Crime against Women), Jaunpur to any other competent court of jurisdiction at Jaunpur. Power of attorney has been filed by Mr. Rajesh Yadav on behalf of the applicant, the same is taken on record. Learned counsel submits that the deposition of the applicant was not recorded completely and she was not informed that she has been declared as a hostile witness as she was only asked to sign the deposition sheet. Learned counsel submits that the applicant- complainant has an apprehension that she may not get justice, therefore, she applied for transfer of the trial before the Sessions Judge Jaunpur, but the same has been wrongly dismissed vide order dated 10.02.2025. He prays for transfer of the trial. Concededly, the trial is at an advanced stage, as the prosecution evidence is complete and even the application filed under Section 311 Code of Criminal Procedure by the applicant has been rejected on 15th July, 2020.
