Material aVermentS Stemming from the Case Of the Prosecution are that on 26.08.2025 on credible information about illegal transportation Of ganja, the Inspector of Police along With Staff and mediators reached BT Road, Opposite the old BSNL Office Junction in Salur Town found the accused in Motorcycle bearing No.OD-10-T-8073 and seized 5.060 kilograms Of ganja.

Sri P.Raju Babu, learned COunSel for the Petitioner, Submits that the petit'loner is innocent and has been falsely -Implicated in the alleged offence, without any cogent evidence l'Inking tO the commission Of the Crime. lt.iS contended that the pet'ltioner is the sole breadwinner of his family and his arrest would cause undue hardship and` Prejud'lCe tO the dependents Of the pet'ltioner. The petitioner undertakes tO abide by any COnditiOn that this Court may -Impose wh'lle granting bail to the petitioner.
4. lt is further Submitted that the Petitioner has Permanent Place Of residence and there is no likelihood of him absconding or evading the Process. of law. The petitioner has COOPerated With the investigation thus far and assure continued cooperation in future proceedings. It is also urged that the allegations are of a nature that do not warrant further custodial detention, and if any condit-Ion is imposed while granting the bail, the pet'ltioner would not violate it; anc! it is urged to allow the petition.

Per confra, Ms.Akhi[a Nat-du, learned Assistant public prosecutor, strenuously opposed the grant of bail, contending that the inves{jgation js still underway and several ma{erjal witnesses are yet to be examI'ned. It I'S submitted that enlargement of the petitioner on ba" at this stage would seriously hamper the progress of the investigatI'On and may result jn non- cooperation from the petitioner. The prosecution further apprehends that the petjtjoner, if released, may I'nfluence or intimidate witnesses, thereby obstructing the course of justice. It Its also urged that there exists a real and immI'n.ent risk of the petjtI-Oner absconding and evading the due process of law. Given the gravity of the al[egatjons and the potential threat to the integrity of the investigation, it is submitted that the petitioner do not deserve the discretionary relief of bailand it is urged to dismiss the bail petitl'on.
6. Thoughtful consideration is bestowed on the arguments advanced by
learned counsel for both sides. I have perused the entire record. POINT FOR
7. ln the light of the case of the prosecution and the contentions oflearned counsel for both sides, now the point for consideration is:
"Whether the petitioner is entitled for grant of bail?''
8. The petitioner/accused No.1, as seen from the record alleged to have indulged in dealing with 5 kgs of ga.nja. It is not a commercial quantity. section
4 29 of lthe NDPS ActJ would also not applicable. The petitioner Was arrested On
26.08.2025. He has been in the iud-ICial Custody for the Past 45 days. So far five witnesses are examined. Thus the subStant'lal POrtiOn Of the investigation in so far the involvements of the petitioner is concerned is completed. The petitioner is permanent res'ldents of RampaklI'l Village, Kesara Mandal, Medchal District, Talangana State. The petitioner has got fixed abode. All the witnesses are official witnesses. Therefore, the queSt'IOn Of Pet'ltiOnerS threatening the witnesses or hampering the investigation or tampering the evidence may not arise. 9. Considering the facts and Circumstances Of the Case, nature and gravity of allegation levelled aga.lnst the petitioner, his alleged role played in this case, and the period of detention undergone by the pet'ltioner, this court is inclined to enlarge the petit.loner on bail with the following stringent COnditiOnS: i. The petitioner/Accused No.1 shall be enlarged On bail subject to he executing a bond for a sum of Rs.1 O,000/-(Rupees ten thousand only), with two sureties each for the like sum each to the satisfaction of the learned Judicial First Class Magistrate, Salur. ii. The petitioner/Accused No.1 sha" appear before the station House Officer concerned, On every Saturday in between 10:00 am and 05:00 pm, till COgniZanCe iS taken by the learned the Trial Court. _ _--
