Bisht, learned counsel for the appellant submits that the controversy has been decided against the appellant by Hon’ble Supreme Court in a judgment rendered in the case of Suman Devi & others vs. State of Uttarakhand & others, reported in 2021 (2) U.D. 303. Thus, he submits that in view of the judgment rendered by Hon’ble Supreme Court, the special appeal has rendered infructuous. 5. Learned State Counsel also supports the said submission made by learned counsel for the appellant. 6.
