Dated 13.10.2025 The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 Petitioner/Accused for granting of pre-arrest bail in connection with Crime I No.39 of 2025 of Nars^raopet I Town Police Station, Palnadu District, registered for ,the alleged offence punishable under Sectioni 15(2), 333, 351(1), read with 62 of the Bharatiya Nyay Sanhita, 2023^ on the allegation that the petitioner/accused sexually assaulted the de-facto complainant. Heard the learned Counsel for the Petitioner and the learned Assistant 2. 1 (for brevity ‘the BNSS’) by the 2. Public Prosecutor. 3. As seen from the record, the allegation against the petitioner/accused is that on 16.03.2025, during late hours, the petitioner entered the house of the de facto complainant, physically assaulted her, and attempted to sexually assault her. When she resisted, the petitioner allegedly threatened her with dire consequences. The learned Assistant Public Prosecutor submits that no wound certificate has been produced. The alleged offence took place on 16.03.2025, and the statement of the 2'"'^ respondent was recorded on 17.03.2025 at about 8;30 p.m. in the hospital. It appears that a compromise was arrived at between the petitioner and the 2"'^ respondent at the police station in the presence of mediators and elderly persons. As per the said respondent agreed to receive an amount of Rs.25,00,000/- within a period of one (01) week, i.e., by 26.03.2025. The said further disputes between the petitioner and the 2 I agreement was signed by the petitioner, Veemula Panduranga, and Chelakala Venkatesh as Party ‘A’, and by the 2'"'^ respondent', B. Venkateswari, and B. Narasimha Rao as'Party ‘B’. So far, eight witnesses have been examined. The petitioner/accused is the elder brother-in-law of the de facto complainant, whose husband had passed away. Thereafter, the petitioner is alleged to have been harassing her sexually. Considering the facts and circumstances of the case, the gravity and 4. nature of the allegations, and also compromise affected in between the petitioner and 2^^^^ respondent, this Court is inclined to grant pre-arrest bail to the Petitioner/Accused. In the result, the Criminal Petition is allowed with the following 5. conditions: In the event of arrest of the Petitioner/Accused he shall be enlarged on bail subject to he executing a personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand Only), with two sureties for the like sum each to the satisfaction of the arresting police officials: The Petitioner/Accused shall make himself available for investigation as and when required; The Petitioner/Accused shall not cause any threat, inducement or promise to the prosecution witnesses; The Petitioner/Accused shall appear before the Station House Officer concerned once in a week i.e., on every Saturday between 10.00 a.m. and 5.00 p.m., till filing of the charge sheet. The Petitioner/Accused shall not leave the State of Andhra Pradesh limits without the express permission from the Station House Officer concerned. i. II. IV.
