PUBLIC PROSECUTOR The Court made the following ORDER: This Criminal Petition, under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioners herein, seeking anticipatory bail, in connection with Crime No.256 of 2024 of Eluru III Town Police Station, Eluru district, registered 2 for the offences punishable under Sections 331(4) and 305(a) of the Bharatiya Nyaya Sanhita, 2023. 2. Case of the prosecution, in brief, is that, on 17.08.2024 evening, the de facto complainant, resident of House No.17-98, Indraprata Vatluru village, Pedapadu Mandal, went to Vijayawada to see his relatives by duly locking his house. On 20.08.2024 morning, when his relatives informed him over phone that main door of his house was broke opened, he went into his house and found that some unknown persons committed theft of gold ornaments worth of Rs.2,41,000/-. 3. Heard. Perused the record. 4. A perusal of the material on record goes to show that the petitioners herein are not arrayed as accused in the aforesaid crime. Learned Assistant Public Prosecutor too concurred that as on date, he has no instructions that the petitioners herein are arrayed as accused in the present Crime. When the petitioners are not arrayed as accused in the present crime, the question of granting anticipatory bail to them does not arise. 3 5. In view of the said reasons, the Criminal Petition is not maintainable and the same is, accordingly, dismissed. As a sequel thereto, the miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed. ________________________ K. SREENIVASA REDDY, J.
