The present application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita has been filed by the applicant with a prayer to issue a direction to the Chief Judicial Magistrate, Bijnor to decide the objection dated 18.02.2025 which is pending in Criminal Case No. 24183 of 2023 (State Vs. Sonu and others) arising out Case Crime No. 265 of 2023, under Sections 406, 420 of I.P.C., Police Station Dhampur, District Bijnor within stipulated period. After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file an appropriate application/ proceedings before the court of competent jurisdiction. Certified copy of the order may be returned to the learned counsel for the applicant after retaining a xerox thereof.
