ORAL ORDER
Heard the learned counsel for petitioner, learned High Court Government Pleader for State and perused the material on record.
2. Petitioner is arraigned as accused No.1 in the chargesheet filed by Ashoknagar Police Station in Cr.No.10/2021 for the offence punishable under Sections 307, 448, 323, 324, 504, 506(B), 149 of IPC.
3. Petitioner was granted bail by the Sessions Court in Crl.Misc.No.25557/2021 vide
order dated
12.5.2021. After committal of the case, on 3.7.2023, he remained absent before the Court. Thereafter, repeatedly NBW was issued against him. Case against him was split- up on 9.10.2024. He came to be arrested on 26.7.2025, pursuant to the NBW issued against him. Since then, he is in judicial custody.

4. The learned Sessions Judge has rejected the prayer for bail, taking note of the fact that the petitioner has absconded and he was not regular before the Court and thereby violated the conditions imposed in the bail
order.
5. The learned High Court Government Pleader contended that if bail is granted, petitioner will once again remain absent and in that event, there will be further delay in trial.
6. It is contended by the learned counsel that the petitioner was regular to the Court, but he lost communication with his counsel, hence, he was not aware of the dates of hearing. He submits, henceforth, the petitioner will regularly appear before the trial Court without fail and will furnish adequate surety to ensure his regular presence.
7. Considering the facts and circumstances, an opportunity can be given to the petitioner, making it clear

that no further indulgence will be shown to him, if the bail conditions are violated. Hence, the following:
ORDER I. Petition is allowed.
II. Petitioner/accused No.1 in Cr.No.10/2021 of Ashoknagar Police Station (SC No.1536/2024) pending before the Court of XXVIII Additional City Civil & Sessions Judge, Bengaluru, shall be enlarged on bail, subject to following conditions:
1. He shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees one lakh only), with two sureties for the likesum to the satisfaction of the jurisdictional Court.
2. He shall furnish proof of his residential address and shall inform the Court, if there is change in the address.

3. He shall not directly or indirectly tamper with the prosecution witnesses.
4. He shall not indulge himself in committing any offence.
5. He shall appear before the trial Court regularly on all dates of hearing.
Violation of condition/s shall result in cancellation of bail.
