Heard Sri Mohammad Umar Khan, learned counsel for the petitioner as well as learned Standing Counsel. By means of this petition filed under Article 226 of the Constitution, petitioner wants retention of the official accommodation on the ground that petitioner's son is studying in Class - 10. Learned Standing Counsel has raised preliminary objection as to maintainable of this second petition on the ground that petitioner had earlier approached this Court by filing writ petition being Writ - A No. 17189 of 2024 in which certain directions were issued for for disposal of the representation and interim protection has been granted. Replying to the above, learned counsel for the petitioner fairly concedes that petitioner had earlier approached this Court and has also made a representation in compliance of the order dated 05.12.2024 passed in Writ - A No. 17189 of 2024. Learned Standing Counsel further submits that the petitioner since was granted a period of one year to retain the accommodation and academic year has come to end on 31.03.2025, the similar relief may not be granted again to the petitioner to defend the order passed by the authority. In the considered view of the Court, once the petitioner has been granted relief to make a representation to retain the accommodation till the academic year 2024-25, I see no justification to interfere in the order impugned. Petitioner should vacate the official accommodation as directed under the order impugned. Petition is accordingly dismissed. Consigned to records.
