JUSTICE SACHIN SHANKAR MAGADUM ORAL ORDER The captioned petition is filed by accused seeking quashing of the proceedings pending in Special C.C. No.1437/2024 before LXX Additional City Civil and Sessions Judge, Bengaluru. Today, an application is filed under Section 528 of BNSS read with Section 359 of BNSS. 2. The application is accompanied by a joint affidavit of the parties. Respondent No.2/defacto complainant is present before this Court and, on being enquired, has submitted that he has amicably settled the dispute with the petitioner. In view of the settlement, respondent No.2 has requested this Court to quash the proceedings pending in Special C.C. No.1437/2024 before the LXX Additional City Civil and Sessions Judge, Bengaluru. - 3 - HC-KAR NC: 2025:KHC:33027 WP No. 25703 of 2025 3. Having regard to the fact that respondent No.2/complainant has agreed to give a quietus to the dispute, and keeping in mind that the offences under the SC/ST Act are not compoundable, but respondent No.2 is not inclined to pursue the prosecution, this Court finds it appropriate to exercise its inherent jurisdiction under Section 482 of Cr.P.C. to secure the ends of justice and prevent abuse of process of law. 4. Accordingly, the application is taken on record. Accordingly, petition is allowed in terms of the settlement. 5. The proceedings in Special C.C. No.1437/2024 pending before the LXX Additional City Civil and Sessions Judge, Bengaluru, for the offences punishable under Sections 504 and 506 of IPC and under Sections 3(1)(r) and 3(1)(s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, are hereby quashed.
