JUSTICE MOHAMMAD NAWAZ ORAL ORDER The petitioners are seeking to quash the entire proceedings in C.C.No.403/2017 pending before the Principal Civil Judge and JMFC, Kanakapura, Ramanagara District. 2. The proceedings are sought to be quashed on the ground that earlier to filing of the complaint by respondent No.2, second petitioner herein had lodged a complaint registered in Crime No.253/2016 in the very same Police Station and the case now registered against the petitioners is a counter blast to the first case. It is also contended that there is a suit pending between the parties in O.S.No.55/2017 before the Court of Senior Civil Judge, Kanakapura and therefore, to wreak vengeance and to - 5 - HC-KAR NC: 2025:KHC:47400 CRL.P No. 13895 of 2025 give a colour of criminal offense to the civil dispute, the second respondent has come up with a false complaint making baseless allegations against the petitioners. 3. As could be seen from the complaint averments, the petitioners herein are alleged to have picked up quarrel with the second respondent on 09.06.2016 at about 5.30 p.m., abused him and his wife in filthy language and when one Sri.Ranganath tried to intervene, he was assaulted with a brick on his head. Further, the accused are alleged to have dragged one Jayamma and Leelavathy and assaulted them with clubs and threatened with dire consequences, etc. As per FIR, certain persons have sustained injuries in the incident. There is a case registered against Ranganath and others on the same day on a complaint lodged by second petitioner herein. 4. From the averments of the complaint, it cannot be said that there is no prima facie case made out against the petitioners. There are specific allegations. Further, the - 6 - HC-KAR NC: 2025:KHC:47400 CRL.P No. 13895 of 2025 statements of the witnesses are also recorded during investigation. It is submitted by the learned HCGP that the charges are already framed in this case and the matter is set down for trial. It is also relevant to mention that in respect of the complaint lodged by the second petitioner herein in Crime No.253/2016 of Harohalli Police Station, charge sheet is already filed and the said case is also pending for trial. 5.
