GP FOR SERVICES II The Court made the following: 10 THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION No.26974 of 2025 ORDER: The present writ petition is filed to declare the action of the Respondents in not treating the past services of the Petitioners rendered on part-time basis for the purpose of fixation of pay and payment towards pension, as illegal and arbitrary. 2. The Petitioners were initially appointed as part-time Vocational Instructors in Government Schools in the consolidated State of Andhra Pradesh. While so, vide G.O.Ms.No.31, School Education (PROG.I) Department, dated 13.02.2009, the services of 1030 part- time Vocational Instructors were regularized by the Respondent-State. Paragraph No.5 thereof reads as under: “5. Government after careful examination of the proposal, decided to regularize the services of Part-Time Vocational Instructors in the existing Craft Teachers vacancies and accordingly, hereby regularize the services of 1030 Part-Time Vocational Instructors who were re- engaged in the Schools in the State in June, 2008 for the academic year 2008-2009 as per the orders issued in the reference 5th read above, in the scale of pay of Rs.5470- 12385 by suppressing 1030 vacant Craft Teacher Posts, with effect from the date of issue of the orders. The Pay 11 and allowances shall be debited to the relevant Head of Account under various Managements, as per rules in force.” 3. Subsequently, original applications were filed before the Andhra Pradesh Administrative Tribunal for counting of their past service for the purpose of pension. The O.As. were filed by similarly situated persons as Petitioners before Andhra Pradesh Administrative Tribunal vide O.A.No.2889 of 2015 and batch. The said O.As. were disposed of with the following directions: “Having regard to the facts and circumstances obtaining in the case and for foregoing reasons, as the applicants were appointed initially on part-time basis as Vocational Instructors by the District Selection Committees and thereafter they were paid salary on consolidated basis and regularized their services through GO.MS.No.31, dated 13.2.2009 and as per the judgments referred to supra, it is clear that irrespective of service either temporary or part-time on consolidated pay or daily wage basis are followed by regularization, they are entitled for counting their service rendered prior to the date of regularization for the purpose of pension. In view of the same, the impugned orders issued in proceedings Rc.No.1225/Estt.4-1/2014-5, dated 8.1.2015 in all these OAs are liable to be set aside and are hereby set aside and further the respondents are directed to pass appropriate orders within a period of eight weeks from the 12 date of receipt of the order. The OAs are disposed of accordingly with the above directions. VMA stands closed. No costs.” 4. Questioning the order in O.A.No.2889 of 2015, W.P.No.1425 of 2019 was filed before this Court. A Division Bench of this Court vide orders dated 15.10.2019 dismissed the same. It is stated that the matter was further carried to Supreme Court and the same was dismissed. Consequent thereto, the Respondent-State issued G.O.Ms.No.179, School Education (Prog.I) Department, dated 18.11.2022, wherein it was decided to implement the orders of A.P. Administrative Tribunal in the O.A. referred above. The concerned authority was directed to count the pre-regularise services rendered by the Vocational Instructors for the purpose of pensionary benefits. Subsequently, the individuals who were not part of the original applications filed before the Tribunal had filed writ petitions before this Court i.e., W.P.No.9381 of 2023 and batch. The said writ petitions were disposed of by this Court vide orders dated 11.05.2023 directing the Respondents to consider the case of the Petitioners therein for extending the benefit of G.O.Ms.No.179, dated 18.11.2022 and the writ appeals filed thereon i.e., W.A.No.29 of 2024 and 13 batch were also dismissed by this Court. The Petitioners who are similarly placed in the above referred cases also seek for extension of benefit of G.O.Ms.No.179, dated 18.11.2022. 5. In this writ petition, learned Assistant Government Pleader does not dispute their own facts and consents for disposal of the writ petition at admission stage as the Petitioners are similarly placed. 6. In that view, the Writ Petition is disposed of directing the Respondents to consider the case of the Petitioners for extension of the benefit of G.O.Ms.No.179, dated 18.11.2022 on par with similarly placed persons within a period of three (3) months. There shall be no order as to costs.
