GOPALA KRISHNA RAO TRANSFER CIVIL MISCELLANEOUS PETITION No.415 of 2024 ORDER: The petitioner/husband herein filed the present petition under Section 24 of the Code of Civil Procedure, 1908 (for short ‘the C.P.C.’), with a prayer to transfer H.M.O.P. No. 86 of 2023, on the file of the Senior Civil Judge, Gooty, to the Family Court, Kadapa, in Y.S.R. Kadapa District. 2. The case of the petitioner, in brief, is as follows: I. The petitioner is the legally wedded husband of the respondent, and their marriage was solemnized on 20.10.2021 at Tirumala, as per Hindu rites and caste customs, and the marriage was consummated. Thereafter, disputes arose between the petitioner and the respondent. Due to matrimonial disputes between both spouses, the petitioner and his wife have been residing separately. Both the petitioner and the respondent are employed in Bangalore. The petitioner/husband pleaded that the respondent/wife filed H.M.O.P. No. 86 of 2023, on the file of the Senior Civil Judge, Gooty, seeking dissolution of the marriage under Section 13(1)(ia)(ib) of the Hindu Marriage Act, 1955. II. The petitioner/husband further pleaded that there is no direct transport facility from Bangalore to Gooty, and he is seeking the 3 VGKR, J Tr.C.M.P.No.415 of 2024 Dated: 09.10.2025 transfer of H.M.O.P. No. 86 of 2023 from Gooty to any other court in Kadapa District. The petitioner further pleaded that the courts in Kadapa District are convenient for the respondent to travel from Bangalore. The petitioner further pleaded that he is an employee in Price Waterhouse Coopers (PWC), Bangalore, and the respondent is working at L&T, Bangalore. The petitioner further pleaded that both parties are employed in private sector organizations in Bangalore and that he is seeking the transfer of H.M.O.P. No. 86 of 2023 from the Court of the Senior Civil Judge, Gooty, to the Family Court, Kadapa, in Y.S.R. Kadapa District. 3. The respondent filed a counter-affidavit denying the material allegations pleaded by the petitioner. The respondent contended that the petitioner, with malafide intention, seeks the transfer of the proceedings, only to harass her and that there is no merit in the present Transfer Civil Miscellaneous Petition filed by the petitioner. Hence, the petition may be dismissed. 4. Heard learned counsel appearing on both sides on record. 5. Perused the material available on record. 6. The material on record prima facie goes to show that the respondent/wife filed H.M.O.P. No. 86 of 2023 on the file of the Senior Civil Judge, Gooty, in Ananthapuramu District, and the said H.M.O.P. 4 VGKR, J Tr.C.M.P.No.415 of 2024 Dated: 09.10.2025 No. 86 of 2023 is pending before the Senior Civil Judge, Gooty, for adjudication. It is not disputed by either party that both parties are currently residing in Bangalore and are employed in private sector organizations, and neither of the parties is staying either in Gooty or in Kadapa. 7. At this stage, the learned counsel appearing on both sides represented that they have no objection, if this Court is inclined to transfer the matter from the Senior Civil Judge Court, Gooty, to the Family Court, Ananthapuramu, because Ananthapuramu is more convenient for travelling from Bangalore to appear before the Family Court at Ananthapuramu. 8. On considering the submissions made by the learned counsel appearing on both sides, this Court feels that it is desirable to transfer H.M.O.P. No. 86 of 2023, on the file of the Senior Civil Judge, Gooty, to the Judge, Family Court, Ananthapuramu, because it is more convenient for both parties to travel from Bangalore to Ananthapuramu. 9. In the result, the Transfer Civil Miscellaneous Petition is allowed, and H.M.O.P. No. 86 of 2023, on the file of the Senior Civil Judge, Gooty, is hereby withdrawn and transferred to the file of the Judge, Family Court, Ananthapuramu. The learned Senior Civil Judge, Gooty, shall transmit the entire case record in H.M.O.P. No. 86 5 VGKR, J Tr.C.M.P.No.415 of 2024 Dated: 09.10.2025 of 2023, to the file of the Judge, Family Court, Ananthapuramu, duly indexed, as expeditiously as possible, preferably within a period of one (1) week from the date of receipt of a copy of this order. Both parties are hereby directed to appear before the Judge, Family Court, Ananthapuramu, on 14.11.2025, at 10:30 a.m. There shall be no order as to costs.
