[2025:RJ-JP:5050] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 1686/2025 Dimpal Kuamr S/o Gopalram, R/o Panchmukhi, Panditpura, Police Station Baswa, Distt. Dausa. (Presently In Sub Jail, Bandikui). ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Vipul Kumar Jaiman For Respondent(s) : Mr. Manvendra Singh, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 05/02/2025 The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No. 133/2024 registered at Police Station Baswa, District Dausa for the offence(s) under Sections 420 and 406 of IPC Learned counsel for the petitioner submits that the accused petitioner has falsely been implicated in this case. Counsel further submits that offences alleged to have been committed by the petitioner are triable by Magistrate. The accused-petitioner is in custody since 18.12.2024 and charge-sheet has already been produced before the concerned court. Counsel further submits that co-accused Pushpendra has already been enlarged on bail and there is no criminal antecedents against the present petitioner. [2025:RJ-JP:5050] (2 of 2) [CRLMB-1686/2025] The trial of the case may take considerable time, therefore, the petitioner may be enlarged on bail. Per contra, learned Public Prosecutor opposes the grant of bail application. Heard and perused the material available on the record. Considering the arguments advanced by the counsel for the parties and looking to the fact that the case of the petitioner is triable by Magistrate and petitioner has remained in custody for a quite long time, therefore, without expressing anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Dimpal Kuamr S/o Gopalram, in connection with FIR No. 133/2024 registered at Police Station Baswa, District Dausa shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
