A case has been registered against the petitioner and others for the offence punishable under Sections 111(2), 319(2), 318(4) read with 61(2) B.N.S and Section 66-C, 66-D of I.T.A.-2000 and Section 3 and 4 of the A.P. Gaming Act. 3. Case of the prosecution in brief, is that on 06.01.2025, on receipt of credible information, S.I. of police, Cyber Crime police station, Visakhapatnam along with staff conducted search at Flat No.610, Gayatri Towers, Opp. Water tank and pump house, backside of Polamamba temple, Doctors Colony, Pedawalta'lr, Visakhapatnam and found that A3 along with A1, A2, A4 and A5 conducting offline and online betting. As per the confessional statement of A3, he used to pool fund for the betting. Upon verification of mobile phones of A3, poI'lce found a total eighty two suspicious transactions and the name of the petitioner was shown at column no.62 of such transactions. The petit'loner was arrested on 17.01.2025 and got remanded to judicial custody. 4. Heard. Perused the record. 5. Learned Assistant Public Prosecutor submits that All is the close associate of A10 and also A8 and all of them involved in gaming |- L--==__. 2 activitl-es, placing bets in lakhs of rupees per game on cricket matches and investigatl'on I®S not yet completed. 6. A perusal of the material available on record goes to showthatthe cyber crime police, on credible I-nformatjon, commenced the I-nvestjgatjon on o6.01.2025 and the case is online cricket betting involving crores of rupees with number of bank accounts, upl transactI'OnS including binami and hawala transactI'OnS. As rightly contended by the learned counsel for the petjtjoner, prima-facie section 111(2) of B.N.S. has no application in respect of the petl-tioner. This court, consI'derl-ng the material on record, the nature of accusation, prl-ma-facie case and stage of l|nvestigation, is incI,'ned to enterta,-n the bail appII'CatiOn Of A8. 7. In vl'ew of the aforesaid facts and cI-rCumStanCeS Ofthe case, thl's court is l'nclined to grant bail to the petl'tioner herein, on the following conditions. (I') The petitioner/A8 herein shall be released on his executing a personal bond for Rs.10,000/-(Rupees ten thousand only) with two sureties for a like sum each to the satisfaction of the chief JudI'Cl-al MagI-Strafe, Visakhapatnam; (ij) on release, the petitioner shall appear before the station House officer concerned once in a week l®.e. on every sunday between 10.00 a.m. and o5.00 p.m., till fI-ling of charge sheet. 8.
