Applicant versus State of Chhattisgarh Through- Station House Officer, Police Station Civil Line Raipur, District- Raipur Chhattisgarh. ... Non-Applicant For Applicant : Mr. Syed Imtiaz Ali, Advocate. For Non-Applicant/State : Mr. Jitendra Shrivastava, Government Advocate. Hon’ble Shri Ramesh Sinha, Chief Justice Order on Board 21.08.2025 1 The applicant has preferred this First Bail Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, as he has been arrested in connection with Crime No.192/2025, registered at Police Station – Civil Line, Raipur, District- Raipur (C.G.) for the offence punishable under Sections 420, 467, 468 and 471 of Indian Penal Code. 2 As per the prosecution story, the complainant filed a written complaint before Police Station Civil Lines, Raipur, alleging that the PREETI KUMARI Digitally signed by PREETI KUMARI Date: 2025.08.22 18:51:16 +0530
2 present applicant took money on the pretext of providing a government job and issued a forged appointment letter. Based on the complaint, the concerned police registered a crime against the present applicant for offences punishable under Sections 420, 467, 468, and 471 of the Indian Penal Code. Hence, this bail application is being filed before this Court. 3 It is respectfully submitted by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in the present case. It is further submitted that the allegation against the applicant is that he took money from the two complainants for providing them with jobs, through online transactions of Rs. 6,00,000/- and Rs. 2,70,000/-, respectively. However, the said amount was taken by the applicant for the treatment of his ailing mother. It is further submitted that the entire amount has since been returned to the complainants and the loan mount has also been paid, and they have also filed affidavits before the learned Trial Court stating that they have no objection to the applicant being granted bail, and that they have received their money. It is also submitted that the applicant has no previous criminal antecedents and charge sheet has already been filed.
The applicant is in jail since 04.05.2025, as the trial is likely to take a considerable time for its conclusion, the applicant prays that he may be released on bail. 4 On the other hand, the learned State Counsel opposes the bail application and submits that a charge sheet has already been filed in the case. He further submits that the applicant took money from the complainants on the pretext of providing government jobs and
3 issued forged appointment letters. It is also submitted that the applicant used the official seal of a Minister, along with other forged documents such as transfer and promotion orders, as is evident from the case diary. Therefore, the present bail application is liable to be rejected. 5 I have heard learned counsel for the parties and perused the documents available on record. 6 Taking into consideration the facts and circumstances of the case, nature and gravity of allegation levelled against the applicant and the fact that the applicant took money from the complainants on the pretext of providing government jobs and issued forged appointment letters, further the applicant used the official seal of a Minister, along with other forged documents such as transfer and promotion orders, as is evident from the case diary, considering the fact that merely because the complainants, who paid money to the applicant, have now received a refund and have expressed no objection, cannot be a valid ground for granting bail, considering the serious nature of the allegations involving forgery of official documents, including appointment letters, transfer orders, promotional letters, and misuse of a Minister’s seal, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail.
7 Accordingly, the bail application of the applicant - Gagan Arora involved in Crime No.192/2025, registered at Police Station – Civil Line, Raipur, District- Raipur (C.G.) for the offence punishable under Sections 420, 467, 468 and 471 of Indian Penal Code, is rejected at this stage. 4 8 Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9 Office is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith.
