ORAL ORDER
Aggrieved with the order passed on an application filed under Section 26 of the Hindu Marriage Act in MC.No.107/2022 dated 08.12.2023 by I Additional Senior Civil Judge and JMFC, Nelamangala, whereby the court had permitted the father to meet his son on any day in a week at time and place preferred by the respondent, the father is before this Court. It is submitted that the court has not given a specific date and the mother is not complying with the order.
2. The petition is filed in the year 2022 and the order is passed on 08.12.2023. Right from 2023, if the mother is not complying with the order passed by the court, the father has a remedy to enforce the said order. Admittedly, except filing a memo, nothing has been done. This order is in fact advantageous to the father. The court says whenever it is convenient to the father, the visitation has to be exercised. If this order is questioned by the mother, at least the court can understand. But how the father is aggrieved, this court is not able to understand. If Sunday is convenient to the father, as

per this order, the mother has to oblige the same. In that view of the matter, this court do not find any reason to interfere. If the order of the court is not complied with, the father is at liberty to file an appropriate petition. Hence, this Court finds no reasons to interfere. Accordingly, this Court is passing the following:
ORDER
(i) The Writ Petition is dismissed.
(ii) All I.As in the writ petition shall stand closed.
