Petitioner has been made accused in connection with MGM (Mango) P.S. Case No. 100 of 2024 corresponding to Special POCSO Case No. 65 of 2024 for the offences registered under sections 376(3) of the Indian Penal Code and section 4 of POCSO Act, pending in the court of learned Special Judge, POCSO, Jamshedpur. 3. Petitioner is alleged to have enticed the niece of the Informant and took her to an under construction building and raped her. Age of the victim has been stated to be 15 years. 4. Mr. Mahesh Tewari, learned counsel appearing on behalf of the petitioner, submitted that the doctor who has examined the victim has opined her age to be 15 to 16 years. 5. Consent of the victim for physical relationship is immaterial as the victim is a minor girl. 6. Considering the nature of allegation, I am not inclined to enlarge the petitioner on bail.
