1. Following relief has been claimed in this writ petition - i. That, the Hon’ble Court may kindly be pleased to direct the respondent authorities to consider and decide the pending representation in the light of circular/Memorandum dated 28/04/2008, 05/05/2016, 28/05/2016 &02/12/2016 issued by the State of Chhattisgarh, within stipulated time frame. ii. The petitioners are praying that, the Hon’ble High Court may kindly be pleased to direct the respondents to grant of second higher pay scale (Time Pay Scale) of Rs.9300-34800+Grade Pay 4200 since 01/04/2006, which is available to the similarly placed government employees after 20 years of service and they be extended all consequential retrial benefits and their pension should be revised according to government circular by giving benefit of 2nd higher pay scale w.e.f. 01/04/2006 with arrears accordingly. iii. That, the Hon’ble Court may kindly be pleased to call for entire records from the office of the respondents in respect of petitioners claim. iv. That, the Hon’ble Court may kindly be pleased to direct the respondents to provide the cost of the petition and other expenses suffered by the petitioners. v. That, any other writ, order, directions or relief which this Hon’ble Court may deem fit may kindly be passed in favour of the petitioners.

Learned counsel for the petitioner submits that for the present, the grievances of the petitioner would be redressed if the petitioner may be permitted to make representation to respondents 3 and 4 / competent authority who may be
directed to decide the representation of the petitioner in the light of circular dated 20/04/2008 (Annexure P/1).

3. Not opposed by the other parties.

This writ petition, at this stage, is disposed off permitting the petitioner to make representation within 45 days from the date of receipt of copy of this order to respondents 3 and 4/competent authority. It is expected that respondents 3 and 4/competent authority shall take decision on such representation within a further period of 120 days from the date of its receipt in the light of final instructions 11/2008 dated 20/04/2008 (Annexure P/1). This Court has not expressed any opinion on the merits of the case. Sd/-
