Order No.02 Dated- 21.02.2025
Heard the parties. This criminal miscellaneous petition has been filed under section 482 Cr.P.C by the petitioner with a prayer for modification of the order dated 07.01.2025, passed in A.B.A. No. 6585 of 2024. It is submitted by the learned counsel for the petitioner that due to printing error, in the order dated 07.01.2025, passed in A.B.A. No. 6585 of 2024 in the operative paragraph, the name of the surrendering court has been printed as ‘S.D.J.M. Tenughat at Bokaro’ instead of S.D.J.M., Bokaro. It is next submitted that unless the aforesaid modification is allowed and extension of time is granted to the petitioner to surrender before the court concerned, the petitioner will be highly prejudiced. Hence, it is submitted that the name of the surrendering court be modified as the court of ‘S.D.J.M., Bokaro’. Considering the aforesaid submission of the learned counsel for the petitioner, the prayer to modify the order dated 07.01.2025, passed in A.B.A. No. 6585 of 2024 is allowed to the extent that the in the operative paragraph, the name of the surrendering court be read as the court of
“S.D.J.M., Bokaro and the time period the petitioner to surrender in the court concerned, is extended by six weeks from the date of this order. The order dated 07.01.2025, passed in A.B.A. No. 6585 of 2024 is modified to the aforesaid extent only. This criminal miscellaneous petition is disposed of accordingly. (Anil Kumar Choudhary, J.)
