Neutral Citation No. - 2025:AHC:77998 Court No. - 5 Case :- WRIT - A No. - 6505 of 2025 Petitioner :- Smt. Aneeta Srivastava Respondent :- U.P. State Bridge Corporation Ltd. And 2 Others Counsel for Petitioner :- Pramod K. Gupta Counsel for Respondent :- Nagesh Kumar Hon'ble Ajay Bhanot,J. The petitioner has been working as Class IV employee in the respondent Corporation. The petitioner claims that he is entitled for regularization of his services. A representation in this regard has been made but to no avail. The only prayer made by Shri Pramod Kumar Gupta, learned counsel for the petitioner is that the representation of the petitioner may be decided within a stipulated period of time. Shri Nagesh Kumar, learned counsel for the respondent nos. 1 to 3 submits the matter requires factual determination as per applicable law by the competent authority in the first instance. The claims of the petitioner need to be ascertained whether he was appointed by the corporation on its rolls, or was a contractual employee engaged by the contractor. However, he fairly contends that the claim of the petitioner for regularization is liable to be decided within a reasonable time frame. In wake of the preceding discussion and without going into the merits of the case, the respondent no. 1 is directed to decide the representation of the petitioner regarding regularization of his services within a period of three months from the date of receipt of a certified copy of this order along with a fresh copy of the representation. It is clarified that this Court has not gone into the veracity of the assertions made in the writ petition nor has judged the claim of the petitioners on merit. It is for the competent authority to do so after independent application of mind and in accordance with law. With the aforesaid direction, the writ petition is finally disposed of.
