2025
1. The instant petition has been filed under Section 528 of BNSS, 2023 for seeking direction to respondent No. 1 to investigate and file the final report/closure report in connection with FIR bearing Crime No. 0124/2021 SOURABH PATEL Digitally signed by SOURABH PATEL Date: 2025.08.21 18:59:48 +0530
2 registered at police station Pankhajur for the offence punishable under section 420, 467, 468 and 471 of IPC.
2. The facts of the present case are that on 18.09.2021, respondent No. 2 lodged a written report against the petitioner, alleging that the petitioner, in collusion with a private contractor, committed financial irregularity of Rs. 30,54,294/- for the construction of a 50-bed Mother and Child Care Hospital at Pankhajur, District Kanker (C.G.). It is alleged that the petitioner signed and prepared forged bills and got the money paid to the contractor for work that was never performed, thus causing loss to the government.
3.
Learned counsel appearing for the petitioner submits that the complaint lodged against the petitioner is mala fide and baseless, as he has not committed any offence as alleged against him. It is further submitted that although the FIR was registered on 18.09.2021 at Police Station Pankhajur, District North Bastar Kanker (C.G.) in connection with Crime No. 124/2021, and the petitioner was granted anticipatory bail by this Court on 20.01.2022, the police have failed to collect any evidence and file a charge sheet against the petitioner despite the lapse of more than four years. Therefore, it is prayed that the instant petition be allowed and the respondent No. 1 be directed to complete the investigation and file a final report or closure report in connection with FIR bearing Crime No. 124/2021.

6.
