The petitioner is a muster roll employee who has been working as Beldar in the respondent-corporation. He claims that he is entitled to regularization of his services on the post of Beldar or any other suitable post. He has made a representation before the competent authority but to no avail. The only prayer made by Shri Pramod Kumar Gupta, learned counsel for the petitioner is that the representation of the petitioner may be decided within a stipulated period of time. Shri Nagesh Kumar, learned counsel for the respondents- corporation submits that the matter requires determination of facts by the competent authority in light of the applicable provisions of law in the first instance. However, he fairly contends that the claim for regularization of his services is liable to be decided by the competent authority in a reasonable time frame. In wake of the submissions made at the Bar and without going into the merits of the case, the respondent No.1- Managing Director, U.P. State Bridge Corporation Ltd. Lucknow is directed to decide the representation of the petitioner regarding regularization of his services as per law within a period of three months from the date of receipt of a certified copy of this order along with a fresh copy of the representation.
